(5) A 130. § (2) bekezdés c) pontja szerint a szabadságra jogosító idő szabályait a Módtv. hatálybalépését követően kezdődött fizetés nélküli szabadság esetében kell alkalmazni.
130. § (1) A munkavállalót minden munkaviszonyban töltött naptári évben rendes szabadság illeti meg, amely alap- és pótszabadságból áll.
(2) A munkaviszony szünetelésének időtartamára a következő esetekben jár szabadság:
a) a keresőképtelenséget okozó betegség tartamára;
b) a szülési szabadság tartamára;
c) a gyermek gondozása vagy ápolása miatt kapott fizetés nélküli szabadság [138. § (5) bekezdés] első hat hónapjára
